Terms of Service and App License Agreement

These Terms of Service and App License Agreement (the "Terms") govern your use of the Scrappy Kin app, website, and related services. They also form the end-user license agreement for the Scrappy Kin iOS app distributed through Apple's App Store.

Scrappy Kin offers a deliberately limited service. It helps you prepare, review, and send personal-data removal requests that you initiate. Scrappy Kin does not read your Gmail inbox or message history, send requests without your approval, or store your personal profile on Scrappy Kin servers.

1. Who we are and who this agreement is with

Scrappy Kin Inc. ("Scrappy Kin", "we", "us") is a Canadian company. These Terms are an agreement between you and Scrappy Kin, not Apple. Scrappy Kin, not Apple, is responsible for the app, its content, and the services it provides.

2. What the service does and does not do

Scrappy Kin connects to Gmail only after you approve Google's gmail.send permission.
The app prepares a group of personal-data removal requests for you to review. You may edit the email wording and your details before anything is sent.
Requests go from your Gmail account to the listed recipient. Scrappy Kin does not route them through its own mail servers.
Scrappy Kin cannot read or search your inbox, sent mail, drafts, message history, or broker replies, and cannot modify or delete your Gmail messages.
Scrappy Kin does not act as your legal representative or guarantee that a recipient will find, remove, or stop collecting your information.

You remain in control of whether a request is sent and what it says.

3. Eligibility and account security

You must be at least 16 to use Scrappy Kin. If you have not reached the age of majority where you live, you may use Scrappy Kin only with permission from a parent or legal guardian.

Scrappy Kin does not create a Scrappy Kin user account. You are responsible for keeping your device and Google account secure and for activity you approve while Gmail is connected. You may disconnect Gmail in the app or revoke Scrappy Kin's permission through your Google account settings at any time.

4. License to use the app

Subject to these Terms, Scrappy Kin gives you a limited, personal, non-exclusive, non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app may also be accessed by other accounts associated with you where Apple's Usage Rules permit that access, such as through Family Sharing where applicable. Scrappy Kin may revoke this license if you materially breach these Terms.

This license does not transfer ownership of the app or its code to you. You may not rent, lease, sell, sublicense, distribute, or commercially exploit the app except where applicable law or an open-source license expressly allows it.

Scrappy Kin publishes the user-facing app code under an open-source license. Nothing in these Terms limits rights granted to you by that license.

5. Acceptable use and third-party terms

You agree not to:

use Scrappy Kin to send spam, unlawful content, messages unrelated to personal-data removal requests, or requests that misrepresent your identity;
interfere with the app, its security, or other people's use of it;
use the service in a way that violates applicable law or another person's rights; or
reverse engineer the app except where applicable law or an open-source license permits it.

You must also comply with applicable third-party terms when using Scrappy Kin, including Apple's App Store and Usage Rules, Google's terms for your Google account and Gmail, and the terms of your wireless or internet provider.

6. Free use, subscriptions, billing, and cancellation

Your first five broker requests are free. No card, no trial clock.

An annual subscription opens the full broker list and covers repeat sends and major updates during the subscription period. The price and renewal terms shown by Apple at the time of purchase apply.

Apple processes App Store purchases, renewals, cancellations, and refunds under its own payment and subscription rules. Scrappy Kin does not receive your card number, Apple Account password, or complete billing details. You can manage or cancel your subscription through Apple's subscription-management controls.

Canceling renewal does not normally end access immediately. Access continues until the end of the paid subscription period unless Apple or applicable law provides otherwise. The app uses the subscription status reported by Apple's StoreKit system to decide whether paid features are available.

7. Privacy

Our Privacy Policy at https://scrappykin.com/privacy.html explains how Scrappy Kin handles personal information and Google user data. It is part of these Terms.

Scrappy Kin stores your local profile and send history on your device. Your personal information is sent only in requests you approve, from your Gmail account to the recipient. It does not pass through Scrappy Kin servers. If you contact Scrappy Kin for support or a privacy request, we receive only the information you choose to include.

For Gmail access, Scrappy Kin follows the Google API Services User Data Policy, including its Limited Use requirements.

8. Maintenance and support

Scrappy Kin is solely responsible for maintaining and supporting the app as required by applicable law. Apple has no obligation to provide maintenance or support for Scrappy Kin.

9. Warranties, Apple refunds, and service availability

Scrappy Kin is provided "as is" and "as available," except for warranties or rights that cannot lawfully be excluded. We do not promise that every broker will act on a request, that the service will always be uninterrupted, or that the app will meet every person's needs.

To the fullest extent permitted by law, Scrappy Kin disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

If the iOS app fails to conform to an applicable warranty, you may notify Apple. Apple will refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Scrappy Kin is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty.

10. Product claims and intellectual-property claims

Scrappy Kin, not Apple, is responsible for addressing claims relating to the app or your possession and use of it. This includes product-liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer-protection, privacy, or similar laws.

If a third party claims that the app or your use of it infringes that party's intellectual-property rights, Scrappy Kin, not Apple, is responsible for investigating, defending, settling, and resolving the claim.

11. Export and sanctions compliance

You may not use or export the app in violation of United States, Canadian, or other applicable export-control or sanctions laws. You represent that you are not located in a country or region subject to a United States government embargo or designated by the United States government as a "terrorist supporting" country, and that you are not listed on a United States government restricted- or prohibited-party list.

12. Changes to or availability of the service

We may update Scrappy Kin, including its broker list, request wording, security controls, and user experience. We may restrict, suspend, or discontinue a feature when reasonably necessary for safety, compliance, platform requirements, or the service's continued operation.

We will not use this section to silently broaden Gmail access or begin collecting personal information in ways that contradict our published Privacy Policy.

13. Limits of liability

To the fullest extent permitted by law, Scrappy Kin is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenue, arising from your use of the service.

To the fullest extent permitted by law, Scrappy Kin's total liability for claims related to these Terms is limited to the amount you paid Scrappy Kin through the App Store during the twelve months before the claim arose.

These limits do not apply where prohibited by law or to liability that cannot lawfully be limited, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence.

14. Indemnity

You agree to indemnify Scrappy Kin against third-party claims arising from your unlawful misuse of the service, your intentional misrepresentation in a request, or your violation of another person's rights, except to the extent the claim was caused by Scrappy Kin's breach of these Terms or applicable law.

15. Governing law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located in Montreal, Quebec, unless consumer-protection law or another applicable law gives you the right to use a different law, venue, or process.

16. Apple as a third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms as they apply to the iOS app. Once you accept these Terms, Apple has the right, and is deemed to have accepted the right, to enforce those provisions against you as a third-party beneficiary.

17. Changes to these Terms

We may update these Terms as the service changes or when legal or platform requirements change. If a change is material, we will update the effective date, describe the change in a reasonably accessible place, and provide any notice required by law.

Your continued use of Scrappy Kin after revised Terms take effect means you accept them, except where applicable law requires a different form of consent.

18. Severability

If any part of these Terms is found unlawful or unenforceable, it will be enforced to the fullest extent permitted by law, and the remaining parts will remain in effect.
